Cottage Grove Man Rapes 7 Year Old, Does Only 2 Years, Released, Rapes 12 year Old Dozens of Times in Two Year Period

 In Cottage Grove, just a block east of Park High School, resided a serial child rapist Donald Oreskovich. According to public court records, in 1995 he was charged with 3 child sex crimes by Washington County prosecutors for raping a seven year old child. Just as is the case in all but a few examples in the last two years, all the charges except one were dropped or dismissed. Oreskovich was convicted of 2nd degree criminal sexual conduct for the rape the following year. Also, just like today, the same broken
Minnesota Law and Sentencing guidelines only gave him 30 months in prison for raping this seven year old child. When he was soon released he eventually moved in a block from the local High School in Cottage Grove, Park High School in a home at  on 79th Street S (address removed because he no longer lives there). No one is allowed to know where sex offenders currently live in MN, literally only a few states in the Country do not allow the public access to this vital information. The best we can do is get the last known address from the original public court data.

As the years went by Don Oreskovich was charged and convicted of failing to register as a sex offender in 1999 and 2007; but again, MN law just gives a slap on the wrist with extended probation in most cases. Never have we seen these child sex offenders get extra prison time for ignoring their registration commitment. Side note, the max sex offender registration in MN is only 10 years.

Fast forward to 2014... Is it any surprise that Don Oreskovich was caught having raped another child under 13? According to the criminal complaint he raped a child multiple times on different occasions over a two year period. In one three month period he said he had sex with the victim "15 to 20 times." The victim stated she'd resist him "but he was too big" and would over power her. Other times he admitted to drugging her water with narcotics and prescription sleeping pills. Almost anyone you ask will tell you the mind of child rapist is so twisted there is little to no chance of "rehabilitating" them like some criminals. The best action most states have found is to not hesitate to lock them up for life on the first conviction or if released require life time registration and strict monitoring on a public run website. 

For Oreskovich, he was convicted of second degree child rape and only because it was the second time with dozens of self admitted accounts of having sex with the child was he sentenced to 30 years in prison. He also admitted to molesting a 9 year old and a 14 year old in the criminal complaint. Should child rapists be locked up for life the first time, or at least intensely supervised for life like in most states? 

This case is NOT uncommon in just Washington County alone. Many convicted rapists from Washington County sexually assault and rape again in the County after their first conviction or even second. These are just some of the articles from the last two years:

Even if County prosecutors got tough on these child rapists and didn't drop over half the initial charges and accept ridiculous plea deals these men would still face minimal prison time and sex offender registration. If you hope to see any law change, continue to contact law makers.

In Minnesota, law makers and prosecutors believe child rapists can be "rehabilitated," do not need to be monitored, and can become good members of society. The evidence is the fact no bill has passed to make sex offender law more tough in the last two years. Also, Only several hundred of the over 20,000 convicted rapists in Minnesota are confined in prison. Most only do a couple years and then are released. More information here:

It's clear that just because a child rapist is charged or convicted, doesn't mean justice will be served after sentencing if convicted. Therefore, if the punishment for ALL criminal sexual conduct crimes is raised than weak charges and convictions will be stronger. With the raised bar there won't be a thing as an outrageous plea deal to lesser rape charges or a weak sentence.

Tell legislators to also make the sex offender list public like nearly every other State in the Country does. All but MN, DC, and Maine have public lists. Maine only has 2,700 sex offenders in their state though. Compared to over 20,000 in MN.

Three Years to Charge Cottage Grove Man Caught with "Library" of Child Rape Videos and Child Porn, No Jail Time Likely

Randy Carl Rappe, age 66, birth date 07/02/1951, was found by FBI and BCA to have dozens of child porn files on a file sharing site. They notified Cottage Grove police who went to his home within the Woodland Park Apartments in Cottage Grove. This was over three years ago in May of 2014. As you read on you may be outraged that this danger to society was left THREE years without being charged it appears. He'll remain free as it's typically another year until conviction, which as you'll also find is of little consequence. Last year the County took 6 months to charge Timothy Pierre of Oakdale for sexually assaulting a 7 and 9 year old multiple times.

What's worse is the WEAK sentence that awaits Randy Rappe (if convicted) like all Child porn convicts past and present in MN. That is, just probation after only a month or two in jail! In January, William Mcginnis, of May Township in Washington County was convicted of four counts of child porn and only got 10 years

. He was initially charged with 9 counts of child porn for having over 70 videos of child porn. His conviction took FOUR years! On the surface the law seems adequate. Each child porn conviction states in the law the penalty is up to 5 years in Jail and $5,000 for each offense in MN Statute 617.247.4(a); but that's never what comes close to happening, as you've just read. Knowing the criminals never face anywhere close to the penalty stated in the law, why do prosecutors only charge for a few counts of child porn when dozens and dozens of files are found? This would possibly add up to an actual penalty in all these cases. According to the criminal complaint, police found nearly 1,000 videos and pictures of child porn. He initially denied knowing the age of the children. But changed his story when the officers started listing off the titles of his files such as "Webcam 12-Year-Old Boys", "Two Young Boys Making Love", and "Eight-to-Ten-Year-Old Russian Flower".

Detectives state in the criminal complaint Rappe had a "card catalog listing videos in almost a library like fashion with a check-in and check-out. Defendant stated he had been trying to catalog all of his movies at one point" Yet he's only charged with 7 counts of child porn?

The most horrifying fact of the case is at least a dozen of the videos Rappe downloaded showed children being violently raped, even infants. Often police will describe the content of the child porn they find in cases like this and the media always fails to adequately explain. Every piece is disturbing and should be remembered by law makers and the public that these men are not in possession material that was mistakenly downloaded or of people that could be considered consenting adults. 

If there's one conclusion to draw from the police descriptions of the child porn all these cases is that they are purely heinous and only the most twisted would collect such material. Yet in Minnesota we take Four years to prosecute them, give them a slap on the wrist, and send them back into society with only five to ten years on the sex offender registry that is hidden from the public. It's not all the County's fault, the pressure rests on law makers.

Child Predator by Forest Lake Public School Convicted on Stiffer Charges, Sentence Still Weak



Nicholas Scott Nehring of Forest Lake looks like an average clean cut guy. His last known address is a nice home at 21122 Clydesdale Curve S. Forest Lake, MN 55025, a stone's throw from the Forest Lake Public schools. He doesn't appear to be the image of a sex offender which in many of our minds is a disgusting unkempt middle age man. The scary fact is Nick is a convicted sex offender it appears. Even more disturbing is the fact most of the child predators in Washington County look like average looking people and there's hundreds of them in the County. According to a 2012 Patch.com article there were 280 sex offenders in the County.

We covered Nick Nehring in February 2017 when he was charged with only Sexual Communication with a minor 609.352.2a(3). A charge so weak he wouldn't have served any jail time or had to register as a sex offender. We added him to the list of public data at WCwatchdog.com, a list of dozens of charged and convicted sex offenders in the County. 

When the 2017 legislative session was ending in May and we saw the crime he was charged with and the sentencing guidelines for the crime were not going to change we covered Nehring again as one of the 10 examples in: Rampant Sex Crime on Children, in Just 2yrs, 10 Cases From County Alone, 8 Simple Laws to Update. We stated his charges were weak and the law was even more weak for punishing Sexual Communication with a minor. 

Perhaps something clicked in the minds of the Washington County Prosecutors because when details of Nehring's conviction came out this month we found the charges had changed to Criminal Sex Conduct-3rd Degree-Victim 13-15 Actor >24m older Statute 609.344.1(b). The facts of the case didn't change. The Criminal Complaint describes the parents of a 13 year old child found sexual communication with Nick Nehring on the child's phone. Forest Lake police investigated and found child porn of the victim and evidence of efforts online to find other child victims through dating sites. When police interviewed him under Miranda rights “He admitted that he communicated electronically with a female he knew was thirteen years old.”

So what changed the minds of the Washington County Prosecutors to up the charges? The county did not respond to question; but it's most likely due to concerned citizens speaking up and saying enough is enough. According to Kare11's article on how the sex offender bills were shut down last session, the County Attorneys Association in MN is one of the biggest opponents. The organization opposed stiffer sex offender laws stating the weak laws and charges "are valuable tools." Leading one to easily conclude County Attorneys generally like weak sex offender laws because it is easier to get a plea deal and avoid costly trial. 

One can not completely fault County Prosecutors for making plea deals to avoid a trial that could result in a not-guilty finding. The County board gives them a small budget with the task they are expected to carry out prosecuting several thousand cases from petty theft to murder. The State also doesn't do the County Attorney's office any help by issuing more responsibilities on their office. We explain in more detail of this dilemma in this article:

Progress is slow to improve MN sex offender laws. It's good to see some good news that Nick Nehring was convicted of his updated charge of 3rd degree Criminal sexual conduct. It appears he will have 15 years of probation with a conditional 180 days in Jail if he violates probation. He will have to register as a sex offender for the current massively weak maximum of 10 years. Please contact our County legislators below to have them fix these laws. We encourage you to contact your legislators to fix the law; but most important is providing help to the local victims. Many groups are out there doing great work across the State. At WCW our focus is local, sharing Washington County related stories to emphasize the reality that sex crime is too common here. But our work doesn't help the shattered victims. So we highly recommend helping local victims through a local group called EmpowerSurvivors. They are a peer led 501(c3) non-profit group for those affected by sexual abuse. One of the many ways they help is by holding free weekly meetings in Stillwater as a safe place. They also host free and private online support on their website and blog. The founder, Elizabeth Sullivan, is a survivor of child sexual abuse and has devoted her life to helping victims here in the Washington County area. Every cent donated goes to their mission of "survivors helping survivors." Their new location in downtown Stillwater could use office supplies such as a printer, pens, paper and more.  Of course any donation amount helps. While the public can find hope and security if laws and sentencing guidelines can improve; the victims of sex crime in Washington County are left shattered by the crime even if the offender is punished to the fullest extent of the law. Man Caught on Surveillance Fondling 13 y/o Child in Oakdale Fleet Farm now Charged

Jesse Garrett Erdman of St. Paul was charged with 2nd degree criminal sexual conduct -Victim under 16 for "allegedly" touching all the private parts you can think of on a 13 year old female in the Oakdale Fleet Farm in Washington County in Late April 2017. He is related to the victim, but to protect the identity of the victim we have withheld what the familial relation is. 

According to the criminal complaint he was caught on video recorded surveillance allegedly stealing merchandise and fondling the child. From the report: 
"Law enforcement viewed store surveillance of the interactions between DEFENDANT ERDMAN and Victim 1, which showed: DEFENDANT ERDMAN walking through the store with his hand in the back pants pocket covering the buttocks of Victim 1; DEFENDANT ERDMAN kissing Victim 1 on the lips; DEFENDANT ERDMAN hitting Victim 1 on the buttocks multiple times over her clothing; DEFENDANT ERDMAN grabbing the genital area of Victim 1 over her clothes in a cupping and fondling manner; DEFENDANT ERDMAN's hand on the genital area of Victim 1 over her clothing;"

Typically in cases like this the Washington County Attorney gives the accused child predator a plea deal. If for some reason Erdman was not offered a plea deal and he was trialed and convicted of this 2nd degree felony, based on past examples, he will likely only have a sentence of 2 years in prison, no fine, and the max allowed probation by law of only ten years and 10 years max allowed by law of sex offender registration. Yes the law says he could get 25 years; but sentencing guidelines dictate the sentence. It could say the punishment is the death penalty and he'd still only get 2 years if convicted because of sentencing guidelines.
