Convicted Child Rapist Only Got Probation and Now Charged with Child and Adult Rape

Convicted child rapist, Justin Martin Ramos, was arrested October 1st at the Key Inn located in Woodbury from a warrant that was out related to a new child rape and a young adult rape case. The first child he was convicted of raping was a 14 year old in 2015. He didn't spend a day in prison, only 69 days credit for time served in Jail while likely awaiting a bail hearing or funds to get bailed out before trial it appears from public state records. For this crime he only received this time served and 5 years probation because of weak MN sentencing guidelines that only legislators have the power to change.

Justin Ramos

According to MN court records he was convicted 6 months later in 2015 for felony failure to register as a sex offender. Again in 2017 he was convicted of felony failure to register as a sex offender. Both cases he received a slap on the wrist and was let go to return to the public (as evidenced by his numerous probation violations).

Fast forward another year forward and in September 2018 he was charged with the rape of a 16 year old and of a 25 year old who said she was also raped "throughout her childhood" by Justin Ramos and on the day in question. According to the criminal complaint Ramos entered the first child's bedroom and got in bed with her while her friend was also in the room having a sleep over. After being raped the child told an adult who was in the home and they called police. When the police investigated they document the 25 year old female explained she was raped "throughout her childhood" and this same day by Ramos. Before leaving the home he told the victim that he had to "go on the run", but he was found days later in Woodbury at the Key Inn.

The Ramsey County Court is charging Justin Ramos with a weak 3rd degree rape charge with force or coercion for the child rape it appears and third degree rape of a impaired/ helpless victim for the rape of the 25 year old (because she was sleeping and awoke to being raped according to the criminal complaint). Judging by the many examples from Washington County, he will likely receive another slap on the wrist with some prison time and up to ten years of probation. These are just some of the articles from the last two years of local charged and convicted rapists going out and raping again in the county:

In Minnesota, law makers and prosecutors believe child rapists can be "rehabilitated," do not need to be monitored, and can become good members of society. The evidence is the fact no bill has passed to make sex offender law more tough in the last two years. Also, Only several hundred of the over 20,000 convicted rapists in Minnesota are confined in prison. Most only do a couple years and then are released. More information here:

If you hope to see any law change, continue to contact law makers, especially Senator Warren Limmer who has refused to pass the sex offender bills in his key special committee in the Senate.

It's clear that just because a child rapist is charged or convicted, doesn't mean justice will be served after sentencing if convicted. Therefore, if the punishment for ALL criminal sexual conduct crimes is raised than weak charges and convictions will be stronger. With the raised bar there won't be a thing as an outrageous plea deal to lesser rape charges or a weak sentence.

Tell legislators to also make the sex offender list public like nearly every other State in the Country does. All but MN, DC, and Maine have public lists. Maine only has 2,700 sex offenders in their state though. Compared to over 20,000 in MN.

Fourteen Year Old Child Raped in Forest Lake. Man Charged and Released. If Convicted, Little or No Jail Time

Austin Keacher of Forest Lake has been charged with third degree rape of a 14 year old child. The criminal complaint states back in May the victim and her friends took their bicycles to a nearby lake to go fishing. They left from the home of the accused child rapist Austin Keacher who lives in Autumn Hills

his public facebook profile
apartments
. The victim realized she forgot her phone back at the home of Keacher so the two of them went back together alone. They went into the garage and the victim had a medical condition that caused her to pass out. The mother of the victim stated in the report the condition was know
n (type of condition withheld to protect the identity of the victim). When she awoke she found Keacher touching her and grabbing her private areas.

(If you'd like to stay informed on the latest sex offenders charged and convicted in Washington County please subscribe to get our free emails.)

Despite repeatedly telling him to stop Keacher was reported to have continued to force himself on her. The police estimated in the report he is six feet tall and weighs over 100 pounds more than the victim. The victims says in the criminal complaint he proceeded to rape the victim in the garage. When police officers spoke to him about the report Keacher admitted to having sex with the victim and that he knew days prior that she was only 14 years old.

Austin Keacher appears to have been released from Jail and into the public on September 12th. It can take a year or longer to get a conviction. In nearly every case the accused child

rapists get insane plea deals because of prosecutors. Plea deal or not, the convictions are weak because of the weak MN law and sentencing guidelines. No bill has passed to make sex offender law more tough in the last two years. It's vital that readers contact their legislators and ask why Representative Matt Grossell is the only legislator writing bills on this and why there are not nearly enough co-signed on the bills.

If Austin Kearcher is convicted of the charged crime, assuming he doesn't get a plea deal down to even lesser charges, he will get very little time in Jail and very little time on the sex offender registry. See some of the many cases in the last couple years of those convicted of the same charges or supposedly more harsh 1st or 2nd degree rape from Washington County:

Homicidal Rapist in Forest Lake Found With Child Porn Who Self Recorded Rape Now Convicted, Only 4 years

This is another article about the combined issue of weak charges, weak sentencing, and it all revolves around weak MN sex offender law. Over two dozen examples just like this and worse in just two years and in Washington

County alone. Check out
http://wcwatchdog.com/local-sex-offender-articles/ and subscribe for free sex offender updates like this post.

Rapist, Alan Douglas Running, from Forest Lake, is finally behind bars... but only for
just over four years. With good behavior, even less time it appears. He will have the maximum of 10 years on the sex offender registration after release it looks like. The sentence alone is alarming. However, what's worse is how he remained free over 90% of the over a year it took to convict (this is common throughout the state). The only reason he spent 42 days in jail, as opposed to none, was because he had two conditional release violations and a total of three warrants out for his arrest during this period of time it appears. Yet time after time the judicial system and weak MN sex offender law let him back out. It appears it all started with the weak charges of only 3 degree criminal sexual conduct of a mentally impaired or helpless victim, stalking, and burglary. The final two charges were dropped to add insult to injury for the rape victim and rape victims across the state. The lawyer representing him was Kevin McHugh Morrison.

Read Criminal Complaint 1 and 2 on how an anonymous tip lead investigators to obtain a search warrant on Al Running in April of 2017 for his house and computers. Detectives were lead to a woman who had a restraining order on him for stalking her in 2015. He was convicted of violating that order in 2016. Police discovered videos Alan Running self recorded with hidden cameras he secretly placed inside her home. In one video he stated how he wanted to kill the woman for ruining his life. Another showed him sexually assaulting her when she was unconscious. He was arrested in June, two months after the discovery, and charged with only 3rd degree criminal sexual conduct, burglary, and stalking. Later, as investigators further searched the "over 100,000 files" of porn on his computer they found 2 files of child porn and confirmed the images were of real children with the center of missing and exploited children. They arrested him again and charged him with two counts of possessing child porn (innocent until proven guilty on those two counts).

If our weak laws and justice system can't detain a man who: video recorded himself raping a woman;
video recorded himself threatening to kill the victim;
broke into her home;
stalked her;
was found with child porn videos;
and violated condition of release twice...
not to mention his criminal past of multiple DWIs and violating restraining order... What rapist can our system serve justice to?

It's a fact MN has the weakest sex offender laws in the Country:

The sex offender list is NOT public in MN; but 47 states do share the data. There are nearly 20,000 registered sex offenders in MN and only about 700 are level 3 offenders that you occasionally hear about moving into the "general area" of a city.

Last year and this year not one sex offender bill passed. Half the bills to make stronger sex offender laws were held back in the house. Senator Warren Limmer called them "non starters" and refused to discuss them in conference committee. The rest were killed in the Senate by the lead of Senator Limmer and Julie Rosen in conference committee. Both refused to comment so far.

If you hope to see any law change continue to contact law makers, especially Warren Limmer.

It's clear that just because a homicidal rapist is convicted and sentenced to just 4 years, doesn't mean justice has been served. Therefore, if the punishment for ALL criminal sexual conduct crimes is raised than weak charges and convictions will be stronger.

Tell legislators to also make the sex offender list public like nearly every other State in the County does. All but MN, DC, and Maine have public lists. Maine only has 2,700 sex offenders in their state though. Compared to nearly 20,000 in MN.

No Justice: Man Who Held Woodbury Woman Captive 2 Days and Raped her Released After 15 Months and Now Charged With Stillwater Sexual Assault

Richard Jay Holmes
Richard Holmes of last known address of 313 Leeward Trail Woodbury has "allegedly" sexually assaulted two people in four years, this time he's charged with sexually attacking a group home resident. He did more time (23 months) for his burglary conviction in 2003 than he did for his first rape crime in 2014 (15 months).  Holmes should have been in prison for over a decade for the 2014 violent rape in Woodbury where he held a woman captive for two days repeatedly beating her time after time and then violently raping her. She nearly escaped twice when while passed out from drinking but she was caught and punched in the face until she couldn't resist. It wasn't until the victim demanded he look what he'd done to her that he let her have her phone according to a DLonline article from 2014

There are dozens of stories just like this where dangerous rapist from Washington County are spending very little time in prison and are released to rape again:   http://wcwatchdog.com/local-sex-offender-articles/. This will continue unless legislators act.

Holmes also has a drug conviction, 3 DWI convictions, violating predatory offender registration, check forgery, and violating order of protection convictions according to the MN BCA.

There are several reasons why Holmes was only locked up for 15 months. The first is the fact the Washington County Prosecutors dropped the rape charge in 2014 and they didn't charge him with kidnapping or higher degree of felony rape charges:
I: 3rd degree sexual conduct (violent rapists like this are usually are charged with 1st degree)
II: 3rd degree assault (1st degree is only for assaulting cops and some gov. workers; 2nd is only if a weapon is used)
III: False imprisonment  609.255 (this charge is far more weak than kidnapping, which if his 2014 crime doesn't fit the description of what kidnapping, what could?  609.25)

Ask the County Attorney Pete Orput why he isn't directing his prosecutors to pursue to the fullest extent of the law Pete.Orput@co.washington.mn.us

The second problem is weak sentencing laws in MN. This is evidenced by how Richard Holmes served more time in prison for Buglary (23 months) than holding a person against their will for two days and raping and beating them (15 months). Other problems with MN law to fix can be found in our related post:

As stated, Richard Holmes "allegedly" sexually assaulted again in less than four years. This time it was a group home resident. According to the criminal complaint on 3/15/18 he pushed the female victim into the bathroom at the home where she injured her arm and then proceeded to attack her and force her to perform a sex act as he exposed himself. The Washington County prosecutors took almost two weeks to charge him with 2nd degree criminal sexual conduct.

Citizens must contact their legislators if you expect to see this change. Find your legislator here: https://www.leg.state.mn.us/leg/districtfinder

It's clear that just because a rapist is charged with heavy rape charges, does not mean they will be convicted of it. Therefore, if the punishment for ALL criminal sexual conduct crimes is raised than plea deals will be less weak.

Tell legislators to also make the sex offender list public like nearly every other State in the County does. All but MN and Maine have public lists. Maine only has 2,700 sex offenders in their state though. Compared to nearly 20,000 in MN.

Only a Year in Jail for Man who Gang Raped 14 Year Old Child in Woodbury

In February of 2017 Dan Kevin Zambrano, age 19, last known address 908 Russell Street St Paul, MN 55101, was charged with several rape charges 6 months after violently raping a 14 year old girl with 3 others in a Woodbury townhouse in August of 2016. Why it took 6 months to charge them is not known. Unfortunately all the charges were dropped and he got a ridiculous plea deal it appears. One of the other men was recently convicted for his role in the rape, Parker Cole Running Jarvis, also got a plea deal. He only got 5 years probation and 10 months in prison it appears. see:

Plea deals like this are extremely common in Washington County and across the State and
Dan Zambrano, picture from
his Public Facebook account
only Legislators have the power to fix the broken Minnesota Laws.

Dan Zambrano, or "Dan Zam" as he likes to go by on social media, was initially charged with strong 1st degree rape charges that would have got him over 30 years in prison according to the criminal complaint:

DATE: 2/10/2017
DEFENDANT: Dan Kevin Zambrano
DOB: 9/2/1998
MN AGENCY: Woodbury Police Department
CHARGE:
I: Aiding and Abetting Criminal Sex Conduct-1st Degree-Penetration - Accomplice Uses/Force/Coerce;
II: Aiding and Abetting Criminal Sex Conduct-1st Degree-Penetration -Cause Personal Injury;
III: Aiding and Abetting Criminal Sex Conduct-3rd Degree-Force or Coercion;
IV: Aiding and Abetting Criminal Sex Conduct-3rd Degree-Victim 13-15 Actor >24m older

He also goes by Dan Kevin on facebook.

Zambrano was added to our running list of charged and convicted sex offenders:Washington County Sex Offenders. Names, Photos, Addresses.

Unfortunately it appears the Washington County prosecutors folded and gave him an even worse plea deal than Parker Jarvis. They got him to plead guilty to 5th degree Criminal Sexual Conduct in order to avoid trial it appears.  This conviction fits that of a drunk at a bar who slaps someone's butt... not for someone who gang rapes a 14 year old child.

Something could have gone wrong in the prosecution of the case to explain this injustice of a plea deal. However, it is doubtful because if there was lack of evidence than all the charges would have been dismissed. We don't know because the County does not answer questions like this.

What is known, is all that is important. The fact a 14 year old child was gang raped and one of the guys who did it is walking with a year in Jail, with 279 days credit for time served, a $1,573 fine, and register as a sex offender for the maximum in Minnesota 10 years.

Citizens must contact their legislators if you expect to see this change. Find your legislator here: https://www.leg.state.mn.us/leg/districtfinder
